Here is the good news. Millions of loans have been bundled and sold to Wall Street investors, therefore, those 3 Magic Words are: “Produce the Note.” The company serving the Default Notice cannot foreclose on your home unless they hold the deed and can send you a copy. Demand a copy immediately and avoid the consequences. Without proof of the deed you can stop the foreclosure. Also make sure your lender has your correct address. And please, do not avoid lender telephone calls—they really do not want your house and under the avalanche of foreclosures you may discover a win/win for each of you.

Due to this avalanche of foreclosure silly mistakes are happening, such as: the number in your address is transposed, your name is misspelled, or the Default Notice was sent to an old address. Mortgage companies have been forced to hire inexperienced help who are making these kinds of mistakes on foreclosure documents. For that very reason you can avoid and even stop a foreclosure and make the mortgage holder start the foreclosure process over, delaying a final auction for months… giving you an opportunity to find that new job or resolve your financial crisis.

Avoid thinking that foreclosure is inevitable, that approach will surely be self-defeating. Remember that old saying: “An ounce of prevention is worth a pound of cure?” This is an important aspect of Defeat Foreclosure. Prevention is an important factor and Defeat Foreclosure will show you how prevention should be a goal in your financial planning. Avoid panic, this is the time to take action.

Changes in Federal loan limits may qualify you for refinancing. A number of government bailout programs for homeowners may help you survive the foreclosure completely. If prevention is no longer an option Short Sale means selling your house, however the Short Sale process is less destructive to your credit.

Here is an important foreclosure tip: Mortgage accepting federal bailout monies have come to realize that spending $60,000 in legal expenses to foreclose on your home has become too costly. It makes more sense for these lenders to reduce the loan amount and sell your house to a new buyer. Defeat Foreclosure will help avoid the Short Sale option from being considered.
